By accessing the eservice.khidmah.com website ("this website"), you shall be deemed to have accepted to be legally bound by these Terms and Conditions. If you do not agree to these Terms and Conditions , please discontinue using this website immediately.

Services

The Services provided herein are conditional upon the Customer's acceptance of and compliance with these Terms and Conditions or any modification made to these Terms and Conditions by Khidmah from time to time. For avoidance of doubt, the Customer is deemed to accept these Terms and Conditions upon the use of the Services.

Khidmah shall have the right to suspend or terminate the Services, or to reject any payment made by the Customer without giving prior notice to the Customer.

Amendments to the Terms and Conditions

KHIDMAH may, without giving prior notice, modify these Terms and Conditions from time to time.

Warranties

KHIDMAH makes no warranty that the Services, software, information or materials provided will be uninterrupted, timely, accurate, reliable, secure and error free and expressly disclaims all liability whatsoever.

Customer's Obligations

The Customer shall ensure that any information posted, permitted or caused to be posted by the Customer is true and accurate and shall be solely responsible for the contents therein.

The Customer shall promptly provide to KHIDMAH, upon request, any additional information which KHIDMAH may consider necessary in providing its Services.

Limitation of Liability

The Customer shall not hold KHIDMAH liable under any circumstances whatsoever for any claim, action, demand, damage or loss as a result of the Customer using the Services.

Customer's Indemnity

The Customer shall indemnify KHIDMAH at all times against any claim, action, demand, damages, loss, expense or cost which the Customer may suffer or incur as a result of the use of the Services by the Customer.

Intellectual Property Rights

All intellectual property rights in the materials and information contained in this website or supplied to the Customer by the Services shall belong solely to KHIDMAH and these material and information shall not be reproduced or used by the Customer for any other purpose unless with the prior written approval of KHIDMAH.

Payment

The Customer shall make payment for the Services in accordance with the terms and conditions for payment specified in the webpages of the specific Services.

Refund Policy

In instances where the Customer feels that a refund is justifiable, he/she must submit a written request for refund. Any request for refund must be submitted by post to KHIDMAH within 30 days from payment or delivery date, which ever is later, at:

First Floor, L1 – 031, Yas Mall, Yas Island, Abu Dhabi, United Arab Emirates.

Please provide the following details together with your request, unless otherwise stated in the specific Service's website:
- Transaction identification number
- Reasons for cancellation or refund

Once the refund is initiated, Khidmah will process the refund with in 5 - 7 working days and it will reflect in your next credit card statement. As per worldwide credit card policy, amount will be refunded to the credit card only (from which the payment was made). Refund cannot be done through cash or cheque.

All requests submitted are subject to approval on a case to case basis.

Receipt of Payment

KHIDMAH shall not be required to supply any receipt for payments made by the Customer to KHIDMAH through the Services or by electronic means. The automatic generated receipts after the transaction will be the only receipt which the Customer will received.

Applicable Law

The law governing these Terms and Conditions shall be the laws of United Arab Emirates and any dispute arising from the use of the Services or in relation to these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts in Abu Dhabi.

Exclusion of Third Party Rights

No person other than the Customer and KHIDMAH shall have any right under this Contract (Rights of Third Parties Act) to enforce any of the terms of these Terms and Conditions.
